Defective products come in all shapes and sizes. Have you ever thought that your popcorn, of all things, might lead to a serious medical problem?
Wayne Watson from Denver, Colorado is reported to have obtained a $7.2 million verdict against Gilster-Mary Lee Corp., The Kroger Co., and Dillon Companies, Inc., for an illness he claimed to have received from inhaling diacetyl, a chemical used to flavor popcorn. A story on the verdict (link found below) notes that many popcorn manufacturers no longer use diacetyl for flavoring.
Although the attorneys at Bianco Professional Association are not personally familiar with the facts of this case, we do find that oftentimes large verdicts are awarded against companies that fail to address a risk after a danger has been recognized.
